Cancelled

On 6 November 2024, Australian Skills Quality Authority (ASQA) sent notices of intent to cancel the qualifications and/or statements of attainment to 7,360 former students of Luvium Pty Ltd after cancelling Luvium's registration effective 19 October 2024 and following an extensive compliance investigation.

Of the 7,360 former students who were sent notices, more than 6,400 provided no response and ASQA therefore on 15.11.24, cancelled their qualifications and/or statements of attainment.

ASQA has received responses from more than 780 former students. ASQA is considering their responses and will advise them of an outcome as soon as possible.

On 21.11.24, TEQSA issued a notice saying that they expect all higher education providers will review their records to identify where students may have used a cancelled qualification for the purpose of admission or RPL to a higher education course of study.

“Where a provider identifies a student may have used a cancelled qualification, in accordance with the provider’s institutional policies and procedures it should address any issues arising from the cancellation of the qualification. For example, any credit a provider offered to the student that relied upon that student having undertaken a legitimate qualification with Luvium Pty Ltd should be reconsidered"

Child safe organisations

The revised Standards for RTOs clearly outline the RTO's responsibilities regarding child safety. Specifically, Standard 4.3 mandates that RTOs identify and manage risks to VET students, staff and the organisation.  

For VET students aged under 18 years, this includes ensuring safety and wellbeing in alignment with principles for child-safe organisations, considering training content and delivery methods. 

Every organisation working with children and young people has a duty to prioritise their safety and wellbeing. Child safe organisations foster cultures where these principles are paramount, with proactive measures to identify risks and protect children from harm. 

The National Principles for Child Safe Organisations provide a framework for embedding child safe practices across various sectors and organisations. These 10 principles guide organisations in creating a safe environment for children and young people: 

  1. Child safety and wellbeing is embedded in organisational leadership, governance and culture. 

  2. Children and young people are informed about their rights, participate in decisions affecting them and are taken seriously. 

  3. Families and communities are informed and involved in promoting child safety and wellbeing. 

  4. Equity is upheld and diverse needs respected in policy and practice.

  5. People working with children and young people are suitable and supported to reflect chi safety and wellbeing values in practice. 

  6. Processes to respond to complaints and concerns are child focused. 

  7. Staff and volunteers are equipped with the knowledge, skills and awareness to keep children and young people safe through ongoing education and training. 

  8. Physical and online environments promote safety and well-being while minimising the opportunity for children and young people to be harmed. 

  9. Implementation of the national child safe principles is regularly reviewed and improved. 

  10. Policies and procedures document how the organisation is safe for children and young people.

Important note

The revised Standards for RTOs have been released as a Policy draft. Consultation on the Credential Policy and the Compliance Requirements closed 20.10.24 with amendments still possible.

Skills Education and Training Tools will be updating the range of PD and compliance tools and templates as soon as the revised Standards become legislation. As yet, they are not.

We are conscious that until the revised Standards become legislation, they are subject to some change and we do not want to push out draft materials and/or incomplete options that will need to be updated at the RTO end in due course.

We will continue to support our Education Matters membership base and customers of our PD and compliance tools and templates as new arrangements become finalised. 

It is expected that the revised Standards will be enacted 1.1.25 and will come into full regulatory effect 1.7.25. This means RTOs must be ready to demonstrate compliance with the new requirements on 1 July 2025. Until then, any ASQA audits have confirmed that they will be against the existing Standards for RTOs 2015.
