Course Access Agreement
For the Advanced RPL Assessor Credentials
Parties:

Note that ‘Participant’ includes the person undertaking the course and the organisation paying for the course if that is not the individual person.

This Agreement covers the following Courses as applicable to the Participant’s registration:

Purchase of registration into one of the named Courses signals agreement with the following:
In consideration for payment of the Registration Fee, the Parties – as owners of the Intellectual Property (IP) of the Courses – grant access to the Course on the following terms and conditions:
Ownership and Intellectual Property:
Payment of registration and actual registration into any one of the Courses does not transfer any right in the materials to the Participant.

Access to the Course is governed by this Agreement and the Terms and Conditions of the Skills Education website, the details of which are listed on this page: https://www.skillseducation.com.au/pages/ts-and-cs
The Parties retain the right to all intellectual property rights, including but not limited to copyright, in respect of the Courses and the Skills Education delivery system. By using the Skills Education site, Participants must not - and agree they will not - attempt to or actually: copy, download, transcribe, recreate, reverse engineer and/or transmit any Course materials in any format.
Neither Party makes claim to existing inventions owned by the Participant that may be submitted for verification as part of the Assessment only or Learn and Assess microcredential Courses.
Access to Course content:
The Participant will be granted access to the Course IP covered by copyright and other valuable consideration for the express purpose of participating in, and completing, the Course in which they are registered.
The Participant must keep all information relating to the content and structure of the Course in strict confidence and not disclose and/or provide it for the development of similar learning programs within Australia or Internationally, either for their own purposes or for that of another organisation, without the Parties’ express written consent.

Payment of registration fees via the online payment system embedded in the Skills Education website OR payment of Tax Invoice issued by Skills Education to the Participant signals the start of registration in the Course and the start of this Agreement.
This Agreement and its specifics will remain in effect for a period of two (2) years from the start of this Agreement.
Limits on Liability:
The Courses are provided with the understanding that the Participant shall exercise their own skill and care with respect to the outcomes of the Courses. The Parties do not give any warranty nor accept any liability in relation to the contents of any of the Courses. If law prohibits the exclusion of such liability, the Parties limit their liability to the extent permitted by law. The Participant agrees to indemnify the Parties from any and all loss, liability, claim or demand as a result of their use of the Course materials and/or the Skills Education website.
Termination of Access:
If the Participant breaches this Agreement or any of the Terms and Conditions for access to the Skills Education website, access to the Course will be terminated immediately. Upon termination, the Participant will have no further right to the Course materials or Course registration. The Participant will not be eligible for a refund or transfer of their registration to any other person or entity.
General:
This agreement shall be governed by the laws of Queensland, Australia and Participants submit to the jurisdiction of the courts of Queensland.
Amendment to this licence must be made in writing and executed by each party.
